Document Updates After Court for Work Visa Cases

In redetermination, the work permit, job offer, LMIA or exemption basis, employer status and applicant’s eligibility must still be valid at the time of re-examination. The result of the court is not a guarantee of approval.

The application must be formally reopened for redetermination and the response deadline must be met. If the LMIA, offer number, contract or passport has expired, the appropriate solution should be determined before sending.
