Under the Family Class (outside Canada), the application is processed with regard to the applicant’s country of residence, and the responsible visa office may request additional documents or an interview. Living together in Canada during processing is not required, and the applicant travels to Canada to finalize permanent residence once the application is approved. If the application is refused, the sponsor usually has a right of appeal to the Immigration Appeal Division (IAD). The core of the case is proving that the relationship is genuine and was not entered into primarily for the purpose of immigration.
Definition of Spouse: Under Canadian law, a spouse is a person who has entered into a legal marriage, and this legal marriage has been registered by an official marriage registration certificate (marriage certificate), whether in Iran or in Canada.
Definition of Common-law Partner: A common-law partner is a person who has lived with the sponsor continuously for at least one calendar year (365 calendar days) at the same physical address, under one roof.
The sponsor must usually be at least 18 years old, be a Canadian citizen or permanent resident, accept the legal financial undertaking, and not be subject to any sponsorship bar. The principal applicant must prove a legal and genuine relationship and be admissible to Canada on medical, criminal and security grounds. A permanent resident sponsor must live in Canada; a Canadian citizen sponsor living outside Canada must show the intention to return to Canada once the applicant becomes a permanent resident.
Professional fees are determined after reviewing the applicant’s circumstances, immigration history, number of family members, the complexity of the matter, and the scope of services required. To receive an assessment and fee information, please book a professional consultation. After the assessment, the services, professional fees, and payment terms will be confirmed in a written retainer agreement.
However, the professional fee for this service is usually between 5,000 and 7,000 CAD, payable in interest-free monthly installments.
Government processing fees, biometrics, medical examinations, translations, credential assessments, courier charges, and other third-party costs are separate from professional fees unless the written agreement expressly states otherwise.
Please prepare clear, legible scans of the documents below and send them to our office. All government application forms will be completed and prepared by our team.
