Refugees and Asylum Inside Canada

A person who is in Canada and is unable to return safely because of a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group, or because of the risk of torture, danger to life, or cruel treatment, may be able to apply for refugee protection. The outcome of each case depends on the individual facts, the credibility of the narrative, the evidence and the law.

In addition to the support criteria, the case must be legally eligible for referral. Previous application history, support in another country, serious inadmissibility, entry through the US land border and Safe Third Country Agreement or other obstacles can prevent referral to the IRB. Mere presence in Canada or economic difficulty is not a basis for asylum.

• All CBSA, IRCC and IRB correspondence;
• Official translation and explanation of any delay, discrepancy or lack of documents.
