The Refugee Appeal Division (RAD) reviews eligible decisions of the Refugee Protection Division. Depending on the record and applicable rules, an appeal may challenge factual, legal, or mixed errors and may sometimes rely on qualifying new evidence. Some claimants do not have a right of appeal to the RAD and may need to consider Federal Court review instead.
There is no right to protest for everyone and it should be checked from the Notice of Decision. The usual deadlines are short: filing the Notice of Appeal within 15 days and completing the Appellant’s Record within 45 days of receipt of written reasons, unless an extension is granted. The grounds of objection can be legal, factual or mixed errors.
